MOGGERZ — Terms and Conditions

1. ACCEPTANCE OF TERMS

By accessing or using the MOGGERZ website (the "Site"), purchasing any MOGGERZ products, or using any MOGGERZ content, services, or materials, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use this Site or purchase our products.

These Terms constitute a legally binding agreement between you and House of Arvind, Inc., a corporation incorporated under the laws of Canada, operating the MOGGERZ brand ("MOGGERZ," "we," "us," or "our").

For customers in the United States, certain transactions may be fulfilled by House of Arvind, LLC, a limited liability company incorporated in the State of Delaware, USA.

2. ELIGIBILITY

You must be at least 18 years of age to purchase products from this Site. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We do not knowingly sell to minors.

Estimated shipping times are provided as a guideline only. MOGGERZ is not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.

5.2 Risk of Loss

Risk of loss and title for products purchased from MOGGERZ passes to you upon delivery to the carrier. We are not responsible for lost or stolen packages once confirmed as delivered.

5.3 International Orders

For orders shipped outside Canada or the United States, you are responsible for all customs duties, import taxes, and fees applicable in your country.

The MOGGERZ name, word mark, and logo mark are owned by House of Arvind, Inc. and are protected under Canadian trademark law. Both the MOGGERZ word mark and logo mark are filed with and protected by the Canadian Intellectual Property Office (CIPO). All website content, including text, images, graphics, videos, and product descriptions, is protected by copyright.

In the United States, MOGGERZ branding is protected through House of Arvind, LLC.

8.2 Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any MOGGERZ content or intellectual property without our prior written consent. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, HOUSE OF ARVIND, INC., HOUSE OF ARVIND, LLC, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE, PURCHASE OF PRODUCTS, OR RELIANCE ON ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

For customers in the United States, disputes relating to transactions fulfilled by House of Arvind, LLC may also be governed by the laws of the State of Delaware where applicable.

15. DISPUTE RESOLUTION

In the event of a dispute, we encourage you to contact us first at support@getmoggerz.com to seek an informal resolution. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with applicable Canadian arbitration rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property rights.
